Talcum Powder Legal Help

If you or a family member has used Talcum Powder, you may be at risk for, or may already be suffering from, the serious side effects associated with the ingredient popular in baby powder. If you have been injured from talcum powder’s harmful side effects, including ovarian cancer, it is important to speak with an experienced Calabasas talcum powder injury attorney to see how you may be entitled to receive compensation for your injuries and losses.

What is Talcum Powder?

Talc is a naturally occurring clay mineral. This mineral is most often ground up into a fine powder and combined with corn starch to create baby powder. The powder is also used in other hygiene and cosmetic products.

How Talcum Powder is Made?

Talc is typically found in metamorphic rocks near convergent plate boundaries. In the United States, talc deposits can be found throughout the country from the Appalachian Mountains in the East to areas of Idaho, Nevada, California, and New Mexico in the West. Talc is mined through drilling or blasting. The talc is then taken to a processing mill and where the mineral is crushed into a powder.

How Talcum Powder is Used?

Talcum Powder is used in a variety of everyday products from dry shampoo to cosmetics. As was previously mentioned, the most common use of talcum powder is in baby powder. Talcum powder is known for its ability to absorb moisture, which helps keep skin dry and avoid chaffing or rashes.

Harmful Effects of Talcum Powder

For decades, studies have shown that Talcum powder is linked to cancer. One way talcum powder can cause cancer is if the powder is contaminated with Asbestos—another naturally occurring mineral that is usually found and mined near talc. Asbestos fibers get into the lungs when inhaled and can cause deadly cancer (mesothelioma).

Sadly, studies have also shown that talcum powder is linked to ovarian cancer—this has left thousands of women facing life-threatening cancer because of a repeated use of a product they thought was safe. Years of research on talc has found that when women used talcum powder as a hygiene product in their genital area, they are more likely to develop ovarian cancer than women who do not. Talc fibers get into the body and contribute to the development of cancer in female reproductive organs. Tragically, ovarian cancer is presently the fifth leading cause of death among women in the country. Because of its location, it many times goes undetected—though the cancer is treatable, especially if found in the early stages, it often spreads to the pelvis and stomach making it much more difficult to treat.

Talcum Powder Litigation

Many women who have used talcum powder and have suffered the tragic side effect of ovarian cancer, have chosen to take legal action against the makers of talcum powder products such as baby powder. Thousands of lawsuits have been filed against Johnson & Johnson and Imerys Talc America, the company’s talc supplier. The main argument these users (the plaintiffs) make in their claims against Johnson & Johnson and their supplier is that the company failed to warn women that their talc products could cause cancer.

As a result of Johnson & Johnson’s decision to allow their talc products to continue to be used, many women unknowingly used the harmful powder and have in turn suffered from the terrible side effect of ovarian cancer—this tragic side effect has resulted in extensive cancer treatments, chemotherapy, surgeries, and in the most tragic cases, death of those who used the talcum powder products. Therefore, Johnson & Johnson should be held responsible for the harm users suffered and provide compensation to those injured by their careless choices. Several cases have already been successful in obtaining financial recovery for injured women by showing that talc in Johnson and Johnson’s baby powder and other products resulted in ovarian cancer.

If you or someone you love has suffered from the use of Talc products, such as Johnson & Johnson’s baby powder or body powder, you may be able to join in filing a mass tort claim against the company. Mass torts allow for many injured plaintiffs to bring a claim against a party or company for their responsibility in manufacturing and selling a harmful product and/or making false claims about it. In a mass tort case, although many plaintiffs are harmed and bring claims, each claim is personal and the differing situations, physical harm, and other specific of each case can be taken into account for individualized damages awards or settlements.
