- Insurance Requirements For Uber Drivers
The basic Uber driver insurance requirement is that each Uber driver must obtain and maintain liability insurance on each and every car and other vehicle operated while driving for Uber with insurance coverage at least equal to or greater than the minimum amount of insurance required in the state in which each Uber operated car and other vehicle is driven.
- Insurance Maintained By Uber - From The Time The Uber Logs In But Before A Trip Is Accepted
From the time the Uber driver logs in to work but before a trip is accepted, Uber maintains secondary insurance coverage of at least $50,000.00 for the Uber’s driver body injury liability to any one injured person and of at least $100,000.00 for the Uber’s driver body injury total liability to every person combined in each accident and at least $25,000.00 for property damage that the Uber driver causes to others, such as property damage to another car, truck, motorcycle, bicycle or other property.
This insurance coverage maintained by Uber is intended to be secondary while the Uber driver’s insurance described further above is intended to be primary. This means that the Uber driver’s insurance is applied first. And if the Uber driver does not have insurance or if for some reason the insurance company for the Uber driver refuses to provide coverage or if the Uber driver’s insurance coverage is not sufficient to cover the injuries and total damages sustained by the claimant(s), then this secondary insurance maintained by Uber kicks in.
The Uber insurance policy may or may not provide insurance coverage for uninsured motorist (UM)/Underinsured motorist (UIM) coverage or personal injury protection (PIP), depending on whether it is required by the state law in which the Uber driver operates his or her car or other vehicle.
- Insurance Maintained By Uber - From The Time The Uber Driver Accepts The Trip Until The Time The Trip Is Concluded
From the time the Uber driver accepts a trip (that is, after the Uber driver has already logged in and then accepts a trip or a job) until the trip is actually concluded, Uber maintains primary insurance coverage of at least $1,000,000.00 for the Uber driver’s liability for the entire accident or incident that the Uber driver causes to others, such as injury, damages and property damage to another car, truck, motorcycle, bicycle or other property. In addition, Uber maintains insurance coverage for uninsured motorist (UM)/Underinsured motorist (UIM) coverage or personal injury protection (PIP) of $1,000,000.00 per accident that essentially covers the passengers in the Uber vehicle if the insurance coverage of another car or other vehicle is insufficient to pay for all of the damages sustained by Uber passengers.
Note: the insurance coverage minimum maintained by Uber for logged in drivers BEFORE the trip starts is divided into categories (e.g., minimum coverage for one injured claimant, minimum coverage for more than one injured claimant combined, and property damage; while the insurance coverage minimum maintained by Uber for logged in drivers AFTER the trip starts is NOT divided into categories but is a much larger but single limit coverage for all injured claimants and property damaged. This creates many interesting scenarios depending on how many different people are injured, cars and other property damaged, etc. Our Uber personal injury lawyers can go over this with you and explain the complexities and strategies to you when such circumstances occur.
