Key Takeaways
● Ladder accidents cause serious injuries at home and at work and a fall from even a few feet can be life-changing.
● Responsible parties can include employers, property owners, landlords, contractors and ladder manufacturers if the ladder was defective.
● Injured workers usually receive workers’ compensation, but may also have a third-party claim against someone else who was at fault.
● If a ladder fall is fatal, eligible family members may bring a wrongful death claim, generally within two years.
● Do not throw the ladder away. It may be the most important piece of evidence in your case.
● Seek medical care first. Then speak with a lawyer before giving a statement to an insurance company.

Ladder Accident Statistics: Here Are the Numbers You Should Know

Ladders seem simple, but falls remain one of the most serious causes of injury and death in the United States.  Here’s what government data shows:

Key Statistics
● The U.S. Bureau of Labor Statistics (BLS) recorded 844 fatal work injuries from falls, slips and trips in 2024, including 666 from falls to a lower level.
● In construction alone, there were 389 deadly falls, slips and trips in 2024, just over one-third of the 1,034 workplace deaths in private-sector construction.
● A CDC study of 2011 data estimated about 34,000 ladder fall injuries among workers were treated in emergency departments in a single year, about 14% requiring hospital admission, and 113 workers died from ladder falls.
● These figures capture mainly workplace injuries. Falls at home are often under-counted.

Types of Ladders and Why Choosing the Right One Matters

There are different types of “ladder.” Each type is built for a different job and using the wrong one is a leading reason people fall. Common types include:

  • Step ladders: self-supporting, A-frame ladders for work at moderate heights. They must be fully opened and locked and the top cap should not be used as a step.
  • Extension ladders: lean against a wall or roof edge and extend to reach high places. They need a stable base and the correct angle.
  • Platform ladders: have a larger standing surface and a guard rail for tasks that require standing for longer periods.
  • Step stools: short stools for light household reaching, not for roof or high-shelf work.
  • Multi-purpose (combination) ladders: can be configured as a step ladder, extension ladder or other forms. Hinges and locks need proper engagement.
  • Telescoping ladders: compact ladders that collapse. Locking mechanisms can fail if they are worn or not fully engaged.
  • Folding ladders: articulated ladders that fold for storage and can fail if hinge locks are not secured.

Each ladder also has a weight rating that must cover the person plus tools and materials. A ladder that is too short, too weak or the wrong type for the job may be unsafe and the person or company who selected or supplied it may share responsibility.

Common Causes of Ladder Accidents

  • Defective or poorly maintained ladders, including cracked rails, bent rungs, worn feet, broken locks, or missing parts.
  • Unsafe placement, such as uneven or soft ground, wet surfaces or an extension ladder at the wrong angle.
  • Wrong ladder for the job, including ladders that are too short or not rated for the load.
  • Lack of training or fall protection at work and failure to follow safety rules.
  • Unsafe work environments, including slippery floors, cluttered areas, poor lighting, nearby power linesor heavy foot or vehicle traffic.
  • Failure to secure the ladder, such as no one holding it, no tie-off or no barricade in a busy area.
  • Overreaching, carrying heavy items while climbing or standing on the top steps.
  • Third-party negligence, such as someone bumping a ladder or a contractor leaving hazards in the area.

Safety rules matter in these cases. Federal OSHA sets ladder requirements for construction (29 C.F.R. § 1926.1053) and California has its own portable ladder rules (Cal. Code Regs., tit. 8, § 3276). Violating these rules does not automatically decide a case, but it can be strong evidence of negligence.

Common Injuries From Ladder Falls

Because victims often land on hard surfaces from a height, ladder accidents can cause serious and lasting harm, including:

  • Traumatic brain injuries and concussions
  • Spinal cord injuries, back and neck injuries, and paralysis
  • Broken arms, wrists, hips, legs and ankles
  • Pelvic fractures
  • Shoulder, rotator cuff and knee injuries
  • Internal organ injuries and internal bleeding
  • Facial and dental injuries
  • Death

Some injuries, such as brain injuries, may not be obvious right away. Seeing a doctor promptly protects both your health and your claim.

Who May Be Responsible for a Ladder Accident?

Depending on the facts, more than one party may be legally responsible:

  • Employers who failed to provide training, proper equipment or fall protection. (Employers are generally covered by workers’ compensation, discussed below.)
  • Property owners and landlords who created or ignored dangerous conditions, or who supplied unsafe ladders. This falls under premises liability principles.
  • General contractors and subcontractors whose negligence created hazards on a shared site.
  • Ladder manufacturers, distributors and sellers. California product liability law can hold them responsible for a design defect, a manufacturing defect or inadequate warnings (see Barker v. Lull Engineering Co. (1978) 20 Cal.3d 413).
  • Maintenance or rental companies responsible for inspecting or supplying equipment.
  • Homeowners and other individuals whose negligence contributed to the accident, often covered by liability insurance.

Pinpointing every responsible party is crucial because each may have its own insurance coverage.

Injured at Work? Workers’ Compensation and Third-Party Claims

If you were hurt on the job, you will likely have a workers’ compensation claim, which can pay for medical care and part of your lost wages regardless of fault. In most cases you cannot sue your employer for negligence (Lab. Code, § 3602). But workers’ compensation does not pay for pain and suffering. If someone other than your employer contributed to the accident, such as a defective-ladder maker or another contractor, you may also bring a third-party claim (Lab. Code, § 3852) to seek additional compensation.

Workers’ compensation has its own short deadlines. In general, you should report the injury to your employer promptly and within 30 days (Lab. Code, § 5400).

Recent California Supreme Court Decisions for Contractor Workers

If you are a contractor’s employee injured on another company’s property, California’s “Privette” doctrine presumes the hiring company is not responsible for your job-site safety. Two 2021 decisions are important:

  • Gonzalez v. Mathis (2021) 12 Cal.5th 29: a landowner generally has no duty to fix a known hazard for a contractor’s worker, though liability may still exist if the hirer retained control of part of the work and used it in a way that affirmatively contributed to the injury or where hazards were concealed.
  • Sandoval v. Qualcomm Inc. (2021) 12 Cal.5th 256: a hirer’s mere failure to provide safety measures is generally not enough; the hirer’s own conduct must affirmatively contribute to the injury.

Whether a claim is possible can turn on who controlled the ladder, the work area and the safety decisions. An attorney can analyze this early.

When a Ladder Fall Is Fatal: Wrongful Death Claims

Every year, families lose a loved one in a ladder accident. When another person’s or company’s negligence or a defective product, causes a death, California law allows certain family members to pursue a wrongful death claim. Under Code of Civil Procedure section 377.60, this generally includes the surviving spouse or domestic partner and children, or if there are none, those who would inherit under California law. Others, such as dependents, may also qualify in some situations.

Compensation in a wrongful death case may include loss of financial support, loss of household services, funeral and burial costs and the loss of love, companionship, comfort and guidance. The estate may also have a separate claim for the person’s own losses before death. A wrongful death lawsuit is generally due within two years of the date of death (Code Civ. Proc., § 335.1) and a claim against a government entity can require written notice within six months (Gov. Code, § 911.2).

Our wrongful death attorneys handle these cases with compassion. We know no amount of money can replace a loved one. We work to hold responsible parties accountable and help families move forward.

What Compensation May Be Available?

  • Past and future medical expenses, including surgery, rehabilitation and in-home care
  • Lost wages and reduced earning capacity
  • Pain and suffering and emotional distress
  • Loss of enjoyment of life
  • Loss of consortium for a spouse in some cases
  • Property damage, such as damaged equipment
  • In wrongful death cases, the damages described above

California applies comparative negligence (Li v. Yellow Cab Co. (1975) 13 Cal.3d 804). If you share some fault, your compensation may be reduced by your percentage of responsibility but not eliminated. Past medical damages are generally limited to amounts actually paid or incurred (Howell v. Hamilton Meats & Provisions, Inc. (2011) 52 Cal.4th 541). No lawyer can guarantee a result, because every case depends on its facts.

Common Mistakes and Insurance Company Tactics

Insurers often argue that you used the ladder incorrectly, were not careful or already had a pre-existing injury. They may request a recorded statement early or offer a quick settlement before your recovery is clear. Employers and ladder manufacturers may also dispute whether the ladder was defective. Avoid these mistakes:

  • Discarding the ladder or letting it be repaired.
  • Delaying medical treatment.
  • Signing broad medical releases or accepting an early offer.
  • Missing a deadline.
  • Assuming workers’ compensation is your only option when someone else may share fault.
