I want to thank you so much for the excellent result on a very difficult case. My elderly mother went to her HMO in Woodland Hills with a cold. Other than her cold, with major breathing problems from that cold, she was in good health. Although elderly with trouble breathing, she was not hospitalized or even given a chest X-Ray or EKG. She was told she would get better soon and sent home. Shockingly, she died later that evening. We believe had she received better care she would have survived. After all, even her doctors said it was just a cold and she should get better soon. We still don't understand why they would not even do a chest X-ray or EKG for an elderly person with a cold with breathing problems? We tried to settle, but the HMO said its care was proper, she was elderly, and its adjuster denied any responsibility and refused to settle. Apparently, the HMO wanted us to believe that it was just a coincidence that my mother, with major breathing problems, was told she would be fine but just happened to pass a few hours later? We retained the Walch Law Office. The HMO retained a big defense firm who seemed to have an unlimited budget to hire its own medical experts to fight us every step of the way. The HMO even filed a motion to dismiss our case, called a Motion for Summary Judgment, with a declaration from its medical expert stating the medical care was proper and it did not cause her death, but fortunately its motion did not succeed. You obtained copies of all medical records, carefully reviewed the case, retained and consulted with two medical experts of our own, successfully opposed the HMOs motion and were able to convince it to settle. The HMO insisted the terms be kept confidential so I won’t go into them now. I am a very busy doctor and, for that reason, not the easiest client, so I really want to thank you for keeping me informed, scheduling things for my convenience, and even rescheduling things, again for my convenience, never giving-up and getting such a good result. When I had other unrelated legal questions, you always tried to assist without charging me for this extra time. I really appreciate everything you did.
